DIS represented a woman pedestrian who tripped and fell on a broken and raised tree grate on the sidewalk in front of a commercial property. Injuries resulted in the diagnosis of Reflex Sympathetic Dystrophy, otherwise known as Complex Regional Pain Syndrome, an incurable and life altering condition. The defendant property owner had denied the existence of a dangerous condition on the property and, during the course of discovery, either negligently or intentionally lost possession of the subject grate. DIS asked the Court to impose sanctions on the defendant for spoliation of evidence. The case settled while the motion was pending.
