DIS represented a woman who was a guest at a friend’s rental home when she slipped and fell on a wet wooden handicap ramp that had been constructed by a former tenant.  Upon being contacted, DIS immediately went  to the scene to photograph and measure the wooden ramp and quickly discovered, from reviewing applicable building codes, that the ramp was not built in compliance with applicable OSHA codes. From reviewing answers to interrogatories and taking the deposition of the property owner, it was revealed that the property owner had visited the rental home after the ramp was built by the prior tenant and failed to take any remedial action to make the ramp safe and code compliant.  After DIS was able to establish that the owner had actual notice of the dangerous condition causing the client’s fall, the case settled while on the trial list.
